Although it was argued that the International Humaniatarian Law and the International Human Rights Law are part of what has been referred to as „human rights”, the International Humaniatarian Law (IHL) evolved as the international law of armed conflicts, having as main purpose the protection of individuals, even if this protection was not expressed in the formation of subjective rights of the victims, but was the consequence of the rules of conduct of states and state agencies. In this regard, IHL is considered to be a traditional international law, belonging to the objective legal system governing relations between states. However, the human rights have only recently been protected by the international law and are today considered as a matter governed by the national law, at times exclusivly by it. These rights have always been regarded and formulated as subjective rights of individuals (more recently of local communities), that were demanding state’s obligations so that their proclamation would be an act directed against states, mainly against their own state when resulting from international instruments.

România a abordat problematica restituirii proprietăţilor confiscate în timpul regimului comunist total contrar jurisprudenţei CEDO şi modelelor implementate în alte ţări foste comuniste. Trecerea de la o extremă la alta, respectiv de la a considera proprietatea un „moft” la a o considera un drept absolut, a generat, de-a lungul ultimelor două decenii, o serie de legi care au extins procesul de restituire asupra aproape tuturor bunurilor imobile naţionalizate şi au eliminat orice compensare a plafonărilor. Ca urmare, reparaţiile cuvenite proprietarilor de drept au trecut în plan secund, iar procesul de restituire s-a transformat în cea mai profitabilă afacere postdecembristă pentru diverse grupuri de interese cu puternice conexiuni politice. Fraudele, marea corupţie şi iresponsabilitatea înalţilor decidenţi politici au produs pagube imense bugetului de stat, au afectat grav mediul economic şi social şi au adus România într-un impas a cărui depăşire pare imposibilă. Soluţii pentru finalizarea procesului în următorul deceniu există, dar implementarea lor este condiţionată fundamental de manifestarea unei voinţe politice sincere, concertate, la cel mai înalt nivel.

Vue comme une nécessité pour la croissance de l’économie américaine au début des années ’80, la prise en compte des efficiences économiques dans le contrôle des concentrations est aujourd’hui très peu applicable. La difficulté de quantifier et mesurer le bénéfice économique aux consommateurs finals représente un obstacle insurmontable pour les sociétés fusionnantes. Même dans la plupart des cas où les parties en font appel les autorités rejettent les projets de concentration en trouvant facilement qu’une des conditions imposées n’a pas été remplie ou que les gains d'efficacité invoqués ne sont pas suffisants pour compenser le dommage concurrentiel. Les autorités craignent d’autoriser une fusion entre les entreprises détenant un grand part de marché car elle est plus susceptible d’atteindre les intérêts des consommateurs. Alors la mise en balance des gains d’efficacité et les effets anticoncurrentiels est superflue dans les cas de position dominante ou de monopole. La défense de l’efficacité est un moyen de preuve basé sur des hypothèses. Caractérisée par un examen spéculatif tant du pouvoir du marche effectué par les autorités que des efficiences avancées par les entreprises fusionnantes le débat sur comment prendre mieux en compte les gains d’efficacité dans le contrôle des concentrations continue même aujourd’hui.

The main legislative framework created by Law no. 241/2005 on preventing and combating tax evasion after 1989, was supplemented and amended by three acts, respectively Government Resolution no. 873/2005, Government Emergency Ordinance no. 54/2010 and Law no. 50/2013. Through the last amendment brought by Law no. 50/2013, the fine has been eliminated as alternative sanction within Law no. 241/2005, and prison sentences referred to art. 4, art. 5, art. 6 and art. 9 para. (2) and (3) have doubled. All these changes are designed to prevent, detect and combat tax evasion phenomenon which is constantly growing.
