Dla zapewnienia prawidłowego funkcjonowania prawa karnego (jako instrumentu pośrednio wpływającego na kształt stosunków międzyludzkich), koniecznym jest ustalenie i respektowanie uniwersalnych standardów wyznaczających reguły stosowania środków o charakterze penalnym. W przeciwnym razie generować to może różnego rodzaju nadużycia płynące ze strony np. polityków, którzy chcąc uczynić za dość przejściowym zapotrzebowaniom opinii publicznej, mogą zacząć w sposób koniunkturalny wykorzystywać prawo karne. W celu eliminacji tego typu zachowań polski ustawodawca wypracował (mające obligatoryjny charakter) standardy rangi konstytucyjnej, których poszanowanie powinno następować nie tylko na etapie tworzenia prawa ale również przy jego praktycznym stosowaniu.

We present to you this publication comprising articles written based on papers that were delivered at the nationwide conference on mediation in the Polish legal order held on 22 May 2017 at the Faculty of Law and Administration of the Maria Curie-Skłodowska University in Lublin. The conference, organized by the research team of the UMCS Mediation Work Group under the title “Mediation in the Polish legal order: doctrine – legal regulations – practice”, was attended by over 60 scholars and legal professionals specialised in mediation (including academics from five academic centres and representatives of the judiciary, Ministry of Justice, communities of attorneys and legal counsels, and mediation centres as well). It would not be possible to hold the conference and publish the conference material if not the support granted both by the Rectors of the Maria Curie-Skłodowska University and the governing bodies of the Faculty of Law and Administration of the UMCS.

A mobile army of metaphors, metonyms, and anthropomorphisms – in short, a sum of human relations, which have been enhanced, transposed, and embellished poetically and rhetorically, and which after long use seem firm, canonical, and obligatory to a people: truths are illusions about which one has forgotten are illusions ... metaphors that are worn out and without sensuous power; coins that have lost their pictures and now matter only as metal, no longer as coins (Nietzsche 1986).

DRUŽBENA GIBANJA IN ALTERNATIVNA POLITIKA: VSTAJE V SLOVENIJI 2012—2013

Pričujoča številka Družboslovnih razprav (DR) se z različnih gledišč ukvarja z analizami vstaj v Sloveniji v obdobju 2012—2013, ki so s pričetkom v Mariboru jeseni 2012 ob množični udeležbi potekale v številnih mestih po Sloveniji, združevale pa so protestnice in protestnike, ki so izražali nezadovoljstvo z lokalnimi in nacionalnimi oblastmi ter koruptivnostjo političnih in gospodarskih elit, odgovornih za slabo stanje in odnose v državi ter širše. Najbolj množični protesti v Sloveniji po letu 1991 so v lokalnih slovenskih prostorih na ulicah združili izjemno raznolikost vstajniških skupin, iniciativ, gibanj, posameznic in posameznikov v mnoštvo glasov, ki je odločno odgovorilo na globalno krizo neoliberalizma, predvsem na vsiljene varčevalne ukrepe in splošno krizo predstavniškega političnega sistema.

Od prelomnega besedila feministične filmske teorije Visual Pleasure And Narrative Cinema (1989/1975) Laure Mulvey, v katerem je nekoliko pesimistično opisala »moški pogled«, eno okularno logiko, ki žensko na filmu vedno podredi in objektivizira, se je v feministični filmski teoriji in praksi zgodilo izjemno mnoštvo premikov. L. Mulvey je bila po članku večkrat kritizirana, navsezadnje je opisala vseprežemajoče patriarhalno oko, ki si podreja ženske v vsakdanjem življenju in fikciji filma, ki mu podobno kot božjemu ženske pač ne morejo uiti. L. Mulvey je treba šteti v plus to, da je v 70. letih prejšnjega stoletja, zlatem času seksploatacijskega filma, napisala brezkompromisen manifest, ki je fikcijo filma jasno zvezal s feminističnim bojem tistega časa, a manifest je hkrati deloval na način zaprte strukture, ki je ustvarila »ojdipsko, falično paradigmo, ki je veliko bolj totalizirajoča in monolitna kot karkoli so filmi, o katerih govori, sposobni artikulirati.
