Also, the specific elements of this type of agreement can be found in the paper: the period of insurance of assets, the beginning and termination of liability, the insured interest- a condition imposed on the insurance agreement arising from the principle of damage compensation, the insured risk, that future and possible event, the conditions that an event must fulfil and also the insured case.

Due to the importance of vision in human perception, different verbal behaviors are expected in the congenitally blind individuals and the sighted ones. Therefore, in this research, two groups of poets (the congenitally blind and control group of the sighted) were found to explore how differently they represent their perception of the five predominant senses. Strikingly, the statistical results show that the frequency of verbs of vision are not only significantly high but also are more frequent than the same verbs in the poems of the sighted. This might be explained through the fact that perception is reflected and codified in language. Thus, the blind can perceive visual phenomena through language however they are congenitally blind. The second qualitative experiment shows that these blind people use different visual metaphors more than the sighted. This might prove Halliday and Mathiessen’s belief that conceptual structure and semantic structure are just different metaphors of one thing.

The European Union has taken great strides in harmonizing the sale of goods contracts, however the Common European Sales Law is yet to be approved. In 2019, the European Parliament and the Council adopted Directive (EU) 2019/771 of 20 May 2019 on certain aspects concerning contracts for the sale of goods. Some of the main benefits of the directive are: a minimum warranty period of two years from the date on which the consumer receives the good in question and a period of one year for the burden of proof reversed in favor of the consumer, and the possibility for the countries to set longer deadlines than these to maintain their current level of consumer protection. This article is set out to present the steps made towards a unified theory of sales law and some issues that can appear when concepts from different legal systems are adopted into one legal framework.

In today’s technology-driven world, advancements in the internet domain seem to know no bounds. However, while the internet arena has created multiple avenues of development, it has, at the same time, opened up gates for a flurry of illicit activities. Dark web crime has emerged as one such ominous activity that looms over the virtual world and threatens legal systems all across the globe. What started off as the first major internet debacle brought about by the ‘Silk Road’ episode, has now become a source of serious concern for establishing rule of law in the information society. This article delves into the turbid cloud of dark web crimes thriving in the cyber space and the current legal scenario in India to regulate the surge in such malpractices. What stands as a stumbling block before the law enforcement agencies is the transnational element of dark web crimes. While the Indian Penal Code and other legislations comprise provisions related to both territorial and extra-territorial jurisdiction, the extra-territorial jurisdiction is such that it leaves a lot of ambiguity in terms of applicability of Indian laws to cyber offences that may be committed by foreign nationals overseas but the effects of which are felt in India. The author, through the course of this article, brings to light loopholes in the criminal and cyber laws of India, proposes international cooperation as the need of the hour, and analyses if the Budapest Convention on Cybercrimes provides an efficacious solution in this context.

The spreading of the new COVID-19 is changing priorities, bringing new challenges to medicine and disrupting the social-biological-psychological balance resulting in mental health consequences during the active epidemic but more important, in the sequel of the outbreak, with expected long-term effects. First, there are psychiatric patients that tend to be less compliant to containment measures and therefore can present higher risk of infection. Moreover, official protocols recommend the stop of most antipsychotic drugs during infection with Covid-19 which can lead to relapse of mental disorder. On the other hand, restrictions in the healthcare units are impacting the relationship and contact between doctor and patient which in some cases, are psychological comforting and reassuring for the ill during treatment. Another aspect targets general population. The quarantine, work shutdown, self-isolation and unemployment are powerful stress factors with possible significant rise in depression, anxiety, obsessive-compulsive disorder, sleeping disorders, substance abuse (mainly alcohol) and suicidal behaviors. Loneliness and lack of normal daily routine, even in the era of internet and social media can bring up the importance and necessity of human contact and diversified activity. Isolation and closing of educational activity can increase incidence of domestic violence and child abuse within families with such problems but also new such cases can emerge due to stress and tensions between family members. Healthcare workers tend to be affected mainly by stress, lack of sleeping and burnout. All variables must be analyzed on account of prevention and management.

This paper addresses the topic of the entitlement to take legal action of individuals. As it is well-known, persons are called subjects of civil law, and between them a legal relationship occurs. The quality of this subject of law is expressed by what is called the civil legal standing and which includes: the entitlement to take legal action and the legal competence. In this paper, we talk about the notion of entitlement to take legal action of individuals - a component of civil standing. This quality of the subject of law presents all the rights that an individual can acquire. We also present the legal characteristics of the entitlement to take legal action, aspects related to the occurrence of the entitlement to take legal action, the exception of acquiring the entitlement to take legal action from the date of conception, as well as the constitutive elements of the entitlement to take legal action of individuals and in the end we presented the ways of termination of the entitlement to take legal action of the individual.

This research is based on a case study regarding Iranian refugees in Sweden and it strives to find out how Iranian refugees have experienced racism in Sweden; if they have been exposed to racism or not? The aim of this study is to give voice to marginalized people so we might discover the hidden aspects of racism that might not be obvious for any researcher. The data for this article is based on semi-structured interviews that have been conducted with Iranian refugees in Sweden in 2017. Most of the participants in this study were Iranian refugees who have been in Sweden for less than 5 years, at the time of this research. In this paper, drawing on 13 semi-structured interviews, I show that in Sweden, racism emerges in two important levels; individual level and structural level. Furthermore, I show that racism is not limited to a specific group; different ethnicities and nationalities are prejudiced against each other. In addition, the discourse of “them” and “us” exist amongst refugees and immigrants. This distinction has been built upon supposed “cultural superiority” of Swedes which brings about a distinction between immigrants and Swedes in this case

Hyperloop is a new technology that does not exist in any country in the world, but research is ongoing concerning the introduction of such a method of transportation. One of them is occurring in Poland and is preparing to introduce hyperloop in the future. This new technology, which differs in a significant way from conventional rail, will require that current laws be substantially amended, because the current Polish legal system regulates only conventional rail technology. In the case of the hyperloop, a whole new system of supervision on hyperloop infrastructure and trains must be created. The aim of this article in to analyze provisions that will deal with the supervision of a functioning hyperloop. The paper will analyze current legal provisions concerning conventional rail to determine what changes have to be made to assure the proper and safe functioning of the hyperloop. Analysis will cover issues related to infrastructure, such as technical supervision over the operation of the hyperloop infrastructure and vehicles, licensing hyperloop operations and approval of the use of hyperloop vehicles.

America and India share a lot in common. Both countries have rich and diverse democracies with a liberal constitutional framework. Any service-oriented profession inherently poses a risk of some kind to its consumer. But it is the medical profession alone which potentially risks the body and life of its consumer (patient). At the same time, the service provider, i.e. the doctor, or the paramedic, is but a human being, who if severely pressured to dire consequences in case of an error, may not be able to deliver. The American and Indian jurisdictions have different sets of laws to regulate medical negligence. While American laws aim at a quick and effective reparation of injury suffered by patient and his family, the Indian laws are more amorphous in character and can potentially result in a multi-faceted attack on the erring doctor. Courts, particularly the Indian Supreme Court, have often tilted the balance in favour of the patient and his family. This may have serious consequences on the morale of the medical profession, as well as the quality of healthcare, which is ultimately provided to the citizen. The paper seeks to survey the entire law, policy and practice on medical negligence in America and India, by studying the judicial pronouncements by the courts of record in both the jurisdictions. The objective is to propose a viable alternative for balancing the rights and interests of both the patient and doctor, which is not only justice-oriented, but also meets the social requirements.

In the context of the need to implement on the Romanian territory specific measures to prevent the epidemiological spread generated by the evolution of the global pandemic with Sars-Cov-2 virus, we drew attention through this study to the sanctioning instruments invested to apply them amidst civilian population. So, firstly we point out the lack of clarity and foresight of the sanctioning normative acts adopted as a matter of urgency by the Romanian Government as the exceptional legislator that can lead to errors in completing the reports of ascerting and sanctioning petty offences, errors that are likely to cause mischiefs to individuals who came into contact with state agents during the emergency state. Secondly, we evidentiate the potential effects that the declaration of unconstitutionality for the legal provisions regarding the sanctioning regime of the deeds committed in connection with the declaration of the emergency state on the Romanian territory might have, respectively the potential expenses that the state will be required to pay to the citizens sanctioned for misdemeanors generated by the contestation in front of judiciary courts of the sanctioning reports, thus failing to achieve the preventive and repressive purpose of the measures initially generated.

In the last years there has been an international explosion of debates and studies about using cannabidiol in medicine in a diversity of diseases, from oncological pathologies, autoimmune disorders or neurology but the most promising field, from afar, is psychiatry. In 2019, Romania was one of the countries that started discussing the potential use of cannabidiol in pediatric and adult neurology and psychiatry, discussions that divided both scientific and non-scientific worlds. Regarding psychiatry, cannabidiol, as a non-psychoactive compound, could have a spectrum of usage that range from anxiety and depression, post-traumatic stress disorder and most of all, psychotic pathologies. This paper will analyze the possibilities of using this substance for psychiatric patients, both adults and children, by describing the pharmacological attributes, pathophysiological mechanism and clinical aspects, respectively, by assessing the findings and results of the latest studies.

Religion plays an important role in the lives of many and is observed through their individual and collective religious practices and beliefs. Numerous couples present for counseling ascribe to a religious belief system, including beliefs about God’s purpose for their marriage. To understand the worldview of one’s clients and deliver effective services, therapist must increase their understanding of various religious beliefs and practices. While many studies have been conducted in developed Western societies, there have been few that have examined religion as it relates to couple and parent-child relationships in developing societies such as Turkey. Although research is limited, studies of family structure in Turkish society show that religion and cultural values are of primary importance. With the rapid social change from a traditional to more modern culture, it is necessary to examine how religion impacts Turkish couples and family life in a changing cultural context. Thus, this study aims to provide a better understanding of role of religion on family relationships and help clinicians be prepared to serve Muslim clients in Turkey. Implications for clinicians working with religious clients are discussed.

Not only the number of offences have risen but also the character of the offences have become more complex. Law enforcement has faced this phenomenon unprepared and it’s systems of penalty, reeducation and social reinsertion of these youngsters have failed in many cases as the approach on this matter has failed to solve psycho-social and familial problems that reside under the behavioral deviation of youngsters. The truth is that dealing with a child in law system has a more complex and difficult elements the need to be considered, unlike adult delinquency. From under 10 years old to 18 or 21 years there is an abrupt and oscillating evolution of the child’s psychology, personality and cerebral physiology with complex influences by near environment, social and familial factors, intellectual and emotional stimulation. Juvenile delinquency needs to be a multidisciplinary evaluation of the youngster and a complex psychological and psychiatric evaluation of the child’s discernment and personality in order to insure a healthy social adaptation and integration of the future adult.

Recently, in last few months, due to the emergence and amplification of the COVID-19 crisis, Industry 4.0 or the so called 4IR has developed rapidly in various areas of activity such as economic, social, medical, environmental, education, military and not only. This spread of technology has went through among the pillars of sustainability creating new needs, new types of demand and new forms of employment. The labor market has suffered from the replacement of employees with robots and robot process automation (RPA) by eliminating errors, vanishing and generating new jobs. Developing collaborative platforms have led to a new employee salary payment system and to a new way of working among employees. Assisted artificial intelligence operates instead surgeons with high precision. Internet of Things creates a personal network of the individual through which all the objects with which he interacts daily are harmoniously correlated only using a simple Internet connection. Globally and according to the UNO 2030 Agenda, the direction set is to digitize and implement technologies and tools in the Industry 4.0 that will lead to technological progress and the growth of emerging economies and even more growth to the developed ones. The paper comprise an exploratory research, a comparison analysis conducted in different areas of activity to settle the implementation of industry 4.0 within the regions and countries, generating a development ranking progress and forecasts for 2025.

The purpose of this research was to study the demographic and brand experience factors that affected the brand advocacy in sporting goods businesses. The sample groups were the consumers who have used these services before and currently still used sport. The number of the consumers was 400 persons. The research instrument was a questionnaire. The data were analyzed by using descriptive statistics such as frequency, mean, and standard deviation, t-test, f-test, one way ANOVA and Pearson’s Product Moment Correlation Coefficient at 0.05 level of statistical significance.The result of the research indicated that demographic characteristics and brand experience factors had different effects on the consumer sports brand advocacy in Khon Kaen Province significantly at .05 levels.

Criminality as a social and legal phenomenon tends to be generalized. Anti-social behavior has no legal gender differences and they are condemned in the same way, depending on the gravity of the offence. The social and psychological impact of the criminal activity, on the other hand, gives the differences and the severity of the individual and general repercussions inside the affected environment. Although feminine criminality has lower rates, it tends to cover a larger area of severe and brutal felonies with higher impact. In this paper, we intend to analyze gender-dependent characteristics, environmental factors, psychological and physiological elements of female anti-social behavior and a woman’s road to becoming an offender, most often, from the status of familial and social dysfunctional ambiance.
