Kandovan, an Unique Cultural Landscape of Iran, Issues and Strategies

Author(s): Zahra Momeni / Language(s): English / Publication Year: 0

Keywords: Kandovan; cultural landscape; tourism; rock architecture; UNESCO;

In 60 km southwest of Tabriz in East Azarbaijan province, a village with magnificent rock architecture has been formed. The most famous history of about 6,000 years, annually hosts more than 300,000 domestic and foreign tourists. The conical and pyramidal masses formed by the volcanic interactions of the Sahand mountain from thousands of years ago made it possible to settle on the slopes of this mountain. Today this type of landscape is seen in only two examples of the hills in the world (Cappadocia in Turkey, Dakota in the USA) with the advantage of Kandovan, that unlike the mentioned examples which have no inhabitants, the Iranian case is a touristic village and has more than 120 families with the living and working facilities.

Ernesto De Martino: The Reform of Ethnological Studies

Author(s): Aurelia Sabiescu / Language(s): English / Publication Year: 0

Keywords: revaluation; continuity; research; motives; philosophy;

De Martino’s work and his way of thinking gather together the innovative force of a scholar who has managed, without any doubt, to bring about a revolution in the ways of ethnological and anthropological research. Initially disputed, De Martino was later rediscovered due to some favorable trends of cultural interest. He is, therefore, responsible for creating a complex mechanism of thorough study, analysis, understanding and valorification of the traditional social frameworks which are, after all, the origins of European culture. In fact, the capacity of traditional societies to stand up to the ordinary, to confront the present and the ways they have secured their constant presence throughout generations isn’t only through the systematic and sometimes agonizing effort of subsisting, but also due to the existance of those cultural frameworks which represent the means of survival when it comes to mentalities, social rapports and psychological representations. In De Martino’s understanding of the myth, which he designates as the symbolic substance of cultural rite and an instrument used for transcending the limit: „namely, a critical moment for the existence on which weighs the extreme risk of the collapse of the ethos of transcendence and, therefore, that of presence”, and will „also reveal the horizon that recovers this risk, a conversion of the annihilation of presence and its reintegration into simply being”, such we may understand how is actually presents a double transcendence where the rite alters the cultural norm, expressing a „history of origins” related to the moment of crisis.

Drugs: History, Law, Consequences

Author(s): Robert ȘERBĂNESCU / Language(s): English / Publication Year: 0

Keywords: history; narcotics; psychology; law; consequences

The drug phenomenon represents a various and important subject in society nowadays, due to the fact that it is the cause for many studies, criminal activities, legal regulations, international co-operations and lives affected. In this manner, a good understanding of the relationship between humans and narcotics can be formed by researching its evolution throughout history. Since ancient times, people have manifested interest in these substances, either from a philosophical approach or simply by the curiosity of experimenting their effects. The perspective towards drugs suffered many variations, from a positive one, thanks to their medical properties, to a negative one, mainly caused by the severe consequences of overdose and the continuous growth of the underground network belonging to the producers, carriers and dealers. By becoming a threat to the social order, the states had to create and apply laws to counter this rapidly evolving trend. The legal norms brought into existence by the legislative powers covered different topics such as: rules in regards to the production, selling and acquiring, alongside consumption. Domains such as Psychology and Medicine joined forces, especially in the last century, to research and present the effects of long or short term consumption of narcotics.

Keywords: ethic; morality; values; protestantism; capitalism; Max Weber

The Reformation arose from society's reaction to the luxury, immorality and indifference of the clergy of the Catholic Church and returning to the original purity of New Testament Christianity. The Protestant culture supports the principle of equality and individualism. These were the basis for the development of capitalism. Various studies conclude that there is a strong link between Protestantism’s behavioral patterns, concepts of secular ethics and religious doctrines of Protestantism.

Legislative and Jurisprudential Analysis Regarding the Satisfaction of Romanian Patients Regarding the Performance of the National Health System

Author(s): Cristina-Luiza Erimia / Language(s): English / Publication Year: 0

Keywords: patient satisfaction; European law; national legislation; health system

Health spending in Romania is the lowest in the EU, both per capita and as a percentage of GDP, and lack of financial resources and demographic challenges endanger the sustainability of the health system. Because a key factor of patient satisfaction is the responsiveness of the national healthcare system and the strategic changes’ implementation, this article aims to analyse how the standard of protection created at the level of the European Union by means of the Directive on cross-border healthcare is implemented and complied with in national legislation. A modern healthcare system must be centred on patient needs, to have dynamic and integrated structures, adaptable to the various and changing healthcare needs of society in general and of individuals in particular. For these reasons, by presenting the Petru case, the article examines the degree of harmonization of national policies in view of reforming the national health system, contributing to social cohesion and social justice, as well as to eliminate any restrictions to the fundamental freedoms of European citizens.

Some Aspects of the Modern and Contemporary History of Heritage. The Division of the Succession Patrimony of the Monks in the Romanian Law

Author(s): Marinela Marinela / Language(s): English / Publication Year: 0

Keywords: inheritance; succession patrimony; church patrimony; potentials successors; successors

This paper proposes the historical and legal analysis of a part of the matter of inheritances, namely, the succession patrimony of the monks, from the perspective of Romanian law, in the modern era and the contemporary era. We started in the study of this subject from a problem encountered in practice, which concerned the request of the relatives of a deceased monk to hand over to them the goods he owned during his life, in their capacity as successors. First, I analyzed the legal issue through the prism of civil law, as the first impulse of the legal practitioner. After that, I researched the rules of canon law and the norms in the status of various cults, which regulate the legal status of goods that are acquired by monks during the period in which they function as such within the church. In Romanian law there are few cases of this kind, which would allow outlining a judicial practice in the field, which is why we can analyze the problem from the perspective of the normative acts in force and the doctrine, even if it is quite poor. At the same time, to have a correct representation of the factual and legal situation, but also to understand as correctly as possible the issue of inheritances as it is regulated and perceived in the monastic world, I considered necessary the analysis of modern and contemporary legislation and consulted the statute of several cults, to better understand the legal regulation specific to canon law.

Specific Duties for the Romanian Ombudsman During the Period of the Pandemic

Author(s): Mădălina Botină / Language(s): English / Publication Year: 0

Keywords: People’s Advocate Institution; human rights and freedoms; state of emergency

The year 2020 was a challenge for the entire planet in the fight against the pandemic of the spread of the new coronavirus, SARS-CoV-2. Romania was also part of this effort collectively, and the People's Advocate, in his capacity as constitutional guarantor of rights and fundamental freedoms, had to act constantly in order to preserve all rights, assuring citizens that whenever the exercise of some of their rights and freedoms were and are restricted, this is done entirely according to the Romanian Constitution, that is, it is prescribed by law, for the defense of other fundamental values and rights and on a determined duration, without affecting the very substance of those rights and freedoms. I chose as a research topic for this study one of the most important institutions in Romania, the "People’s Advocate Institution". The structure of our paper begins with the presentation of the People's Advocate institution, its structure and the main attributions regarding the human rights situation, taking note of the establishment of the state of emergency and the state of alert on the territory of Romania, which led to monitoring the application of these measures.

Monitoring and Evaluation (M&E) is used in the assessment of the performance of projects, institutions and programmes by governments, international organizations, Non-governmental organizations (NGOs) as well as social media campaigns. The goal of M&E is to improve the current and future management of outputs, outcomes and impact. As the continuous assessment of programmes, M&E grants insights for the controlled evolution of large-scale projects’ relevance, effectiveness, efficiency and impact on a grand scale and with a future-oriented outlook. This article applies an M&E lens to the United States’ Green New Deal (GND) as well as its European pendant the European Green Deal (EGD). Both programs are large-scale endeavors with a long-term impact.

Insolvency at the international level has been for hundreds of years an essential issue of commercial law in general and of international law in particular. There has been a constant attempt to find the appropriate legal instruments to solve creditors’ problems in order to obtain the goodwill that belongs to them, but at the same time to protect the debtor. Along with the economic, social and financial development, there have been several changes in insolvency legislation both domestically and internationally. These legislative changes have become an essential pillar in the economic legislation of a state.

Tax Havens - An Insidious Mechanism for Evading Tax Obligations

Author(s): Narciz Bălăşoiu / Language(s): English / Publication Year: 0

Keywords: tax havens; profit shifting; tax evasion; corporation; fiscal legislation

The development of world trade along with accelerated globalization has an effect not only on economic development or the strengthening of international cooperation, but also facilitated sophisticated mechanisms by which the payment of tax obligations by multinational companies is circumvented. Transfer pricing and tax havens, considered both individual and combined practices, negatively affect a country's ability to implement fiscal policy and improve budget revenue collection capacity. The problem is even greater in the case of states with a fragile economy, where the dynamics of development is vitally related to the elimination of legal, immoral or illegal tax evasion practices. The Transfer pricing mechanism has also been optimized to handle taxable transactions between companies affiliated to a particular group. Multinational companies avoid taxes by overestimating imports and underestimating exports, thus managing to distribute revenues in various regions of the globe that have great tax advantages.

Post-Pandemic: The Working from Home Aspect

Author(s): Robert ȘERBĂNESCU / Language(s): English / Publication Year: 0

Keywords: post-pandemic; work from home; hollow teams; aftereffects; social skills

The SARS-CoV-2 pandemic which hit the world at the beginning of 2020 has forced humanity to implement many changes in a lot of domains. From the simple everyday grocery shop activities to the way one can perform his work for an employer. As a result, life as we know it suffered a series of transformations, both positive and negative. The current paperwork will analyze the consequences raised by the virus in the area represented by the workforce. By this line of approach, we will take into consideration the legal dispositions that had to be adopted and put into practice, the strategy implemented by both companies and institutions in order to protect the health of their employees, alongside the benefits and the negative results derived from these actions. It is certain that moving the work to an individual`s domain has offered him/her an extra amount of time, however the lack of social interaction has left scars on a psychological level. Since one cannot do all the tasks on his own, the work is usually split between team members, but a team cannot be a correct social construct unless social contact is present in real life.

Forensic Expertise in the Case of Road Traffic Accidents

Author(s): Cosmin Butură / Language(s): English / Publication Year: 0

Keywords: accident;infrastructure; forensics; expertise; technology; safety;

In a growing world of population, the world economy and air pollution, urban and rural agglomeration by motor vehicles is caused by the factors stated. Numerous road safety studies have been carried out worldwide, showing that the only means of transport with the lowest mortality rate remain airplanes, ships and trains. Even if the issue of aggressive pollution by driver overcrowding has been asked at the level of international institutions, we cannot talk about a restriction of the human right to enjoy his personal property. This overpopulation has led to the decimation of regulations, conduct and laws governing urban and rural traffic by encouraging citizens to use vehicles with CO2 emissions as low as possible or even electric, bicycles, mopeds, and electric scooters, etc. However, the environment is not the only problem facing large cities, but rather another major problem being the lack of road infrastructure, but exactly the original streets and boulevards are no longer coping with car surpluses. This aspect has forced, in economic developed cities, acceleration of inventions in the field by: bridges, suspended variants or underground passages, motorways and unique boulevards (for example 6 strips per one). Even if there were numerous efforts to reduce the number of cars, it continues to grow daily, the factors being multiple, and traffic accidents in traffic are exceeded. Are we asking why there are still road accidents, given that we are in the century of speed, state-of-the-art technology? Well, if the computers itself produce system errors, then we understand that the human being is the only computer that produces errors that are impossible to prevented. Although there are numerous appearances in the showrooms of large motor vehicles that promise their endowment with advanced artificial intelligence, the social status of each country in the world differs, which makes it impossible to acquire all drivers. So, road accidents cannot be eliminated, they will only be in a continuous prevention, in order to reduce their number and at the same time increasing the safety of pedestrians and drivers. That is why in this paper I will talk about how a forensic expertise is achieved in the case of road accidents.

The Concept of Vernacular Architecture in Contemporary Museum Education in Romania v

Author(s): Astrid Isabela Bogdan / Language(s): English / Publication Year: 0

Keywords: vernacular; architecture; museum education

The subject of this research paper, the open-air museum, we consider that especially in contemporaneity it becomes a main actor on the cultural scene, and through the current study we aim to create extensions of this type of exhibition, extensions that meet the needs of the general public. Moreover, through this paper we aim to systematize the fundamental pillars of vernacular architecture and heritage, but this time, not treating the subject in an exhaustive way, but pointing out its key elements through a series of projects that are currently work in progress. Although through this study we aimed to interrogate only a certain type of exhibition, in this case the open-air museum, in reality we came to new interrogations involving actors from new areas of expertise, areas that we did not anticipate very clearly at the beginning of our research. Thus, we can say that at this moment, the research includes three pillars of work, pillars that we have built based on a methodology for investigating a type of architecture, perspectives based on which we try to build the body of this research. Of course, they are in a process of transformation, based on examples and certain typologies, so that we can answer questions and, why not, launch new questions.

Author(s): Marcel-Leon Treica / Language(s): English / Publication Year: 0

Keywords: Jesus; Messiah; birth; miracol

Within an intercultural dialogue and even between the two religions, we consider that the starting point should be one about which both parts agree. Christianity and Islam are religions that consider the birth of Christ a miracle. At a quick look in the Quran and the Bible we can notice that both sources are alike in many ways. Taking into consideration the appearance of both writings, it is possible that the Biblical description might have influenced the Quran writing or that the Quran writing might confirm the Biblical narrative or that the Quran writing might confirm the Biblical narrative completing it with some other aspects which are not mentioned in the Biblical text. The aim of the present paper is to render The Quran perspective taking into consideration the Biblical narrative.

The Role of the Social Assistant Worker in Romania and the Involvement of the Church

Author(s): Georgeta Stoica-Marcu / Language(s): English / Publication Year: 0

This is the link between the purpose of the criminal investigation and the concrete activities carried out to carry it out. The planning of the criminal investigation is materialized by establishing the objectives pursued by the investigation, by the versions and issues to be clarified in the criminal case, as well as by the methods and means available in order to clarify the issues of the investigated criminal case.
