The changing of constitutional provisions, through amendments, is an important process which determines whether a constitution is rigid or flexible. Constitutional rigidity itself is a very important attribute of the constitution, given that it shows the difficultness of a constitutional amending. Based in that, this paper is aimed at discussing the constitutional rigidity, while surveying the amendment procedure on some of the western constitutions. By doing so, the paper shows some of the factors that might lead to constitutional rigidity; meanwhile the paper addresses some relevant processes that have been subject to constitutional rigidity. Following that, the paper discusses the concept of the constitutional rigidity outcomes, thus building a hypothesis on the situations that the latter leads to. Finally, the paper makes a test upon the hypothesis with a small-N of cases – therefore the hypothesis produced will be a small-N tested hypothesis.

The EU’s military deterrent force in Bosnia and Herzegovina (BiH), EUFOR/Operation Althea, is nearing the end of its 11th year of operation. It came into being in 2004 with great fanfare at a time of EU self-confidence and ambition, succeeding NATO in its role of maintaining a “safe and secure environment,” as prescribed by the Dayton Peace Accords. It appeared then to be a mission of guaranteed success. At its current 600 troops, it is now less than one-tenth of its original mandated strength of over 7,000, which itself was about one-sixth of the strength of NATO’s Implementation Force (IFOR) of 54,000 troops. The force has atrophied as the political will to maintain executive instruments has evaporated among most EU member states. Perversely, its decimation in strength correlates with an incremental regression in BiH’s political atmosphere over the last 8 years; citizens feel less secure today than they did in 2006, according to EUFOR’s own polling data. The country is now completely polarized by an upcoming referendum in the Republika Srpska on the legitimacy of the state-level judicial institutions which Western diplomats and numerous local political actors have declared a “fundamental violation” of the Dayton Peace Accords Western military professionals assess EUFOR’s deterrent and reaction capability as effectively nonexistent. Essentially, it is just a placeholder force to provide a foundation for external reinforcement. Were a crisis, such as organized interethnic violence, to erupt, it would require outside forces to respond, let alone contain. Many interviewees for this report dispute EUFOR’s capacity to secure even Sarajevo International Airport. The legal platform for EUFOR, a UN Security Council resolution, is up for annual renewal in early November. Last year, the Republika Srpska called for the mission to end, followed by a Russian diplomatic attack on the mission in the Security Council and an unprecedented abstention. Russia’s veto in July of this year of the UK-sponsored Srebrenica commemoration resolution, in tandem with the overall tension between Russia and the West, most recently reflected in Russia’s deployment to Syria, make a veto of the renewal a strong possibility. The West, with the EU in a leading role, is responsible for the deterrence failure which has led to a dangerously degrading trajectory in BiH. The growing sense of insecurity has not only made durable progress impossible, but is leading to the increasing likelihood – and gravity – of political miscalculation by the BiH political leaders it has empowered. Renewed interethnic violence remains a real possibility. A credible Western deterrent force, be it under the EU or NATO umbrella, is not only essential to prevent disaster in BiH; it is a prerequisite to enabling a popular consensus in the country so that ultimately it no longer requires external guardians to ensure the peace. Now is the time for the West to take action to bolster its deterrent capability in BiH before, not after, events have spiraled out of control. Unless leading Western powers now forge a consensus on planning and action to fulfil the moral and legal obligations they undertook to maintain the peace in BiH, they will likely suffer the consequences of their failure.

On 29 July a deal was signed in Paris concerning a merger between Krauss-Maffei Wegmann (KMW), Germany’s largest manufacturer of tanks, infantry fighting vehicles and artillery systems, and its French counterpart Nexter. The new holding formed as a result of the merger will be Europe’s largest producer of arms systems for land forces, comparable to the Airbus Group in the aerospace industry. While work on finalising the merger was underway, the German government was developing a new strategy for Germany’s arms industry, which was published on 9 June 2015. The strategy’s provisions show that German politicians, despite holding negative opinions on previous mergers between German arms companies and foreign businesses, have concluded that consolidation at the European level is nonetheless the only way to go. However, the strategy also states that the German government should exercise more influence than previously on the terms and conditions of any such consolidation. To this end, it identified key national technologies which will be supported and protected through various instruments, including also the conclusion of intergovernmental agreements on strategic defence co-operation. Such agreements may regulate questions such as the ownership structures of the new companies, the locations for developing technologies and for manufacturing products, subcontractors and exports of jointly developed arms and military equipment. In relation to the KMW–Nexter merger, such a deal between France and Germany is expected to be signed this autumn.

Falling amounts of natural resources and the ‘peak oil’ question, i.e. the point in time when the maximum rate of extraction of easily-accessible oil reserves is reached, have been among the key issues in public debate in Germany on all levels: expert, business and – most crucially – the government level. The alarming assessments of German analysts anticipate a rapid shrinkage of oil reserves and a sharp rise in oil prices, which in the longer term will affect the economic and political systems of importer countries. Concerns about the consequences of the projected resource deficit, especially among representatives of German industry, are also fuelled by the stance of those countries which export raw materials. China, which meets 97% of global demand for minerals crucial for the production of new technologies, cut its exports by 40% in summer 2010 (compared to 2009), arguing that it had to protect its reserves from overexploitation.

BiH was the first country in the region to amend its criminal code to prohibit joining “foreign paramilitary and para-police formations” which it did in June 2014 and it has since joined the international coalition against ISIL. Operation Damask, undertaken by the State Investigation and Protection Agency (SIPA), the BiH Intelligence and Security Agency (OSA), and the BiH Prosecutor’s Office in late 2014 through early 2015, targeted those suspected of recruiting or financing BiH citizens to go to Syria and Iraq. The BiH Prosecutor’s Office for its part formed a new task force to deal specifically with these types of cases. The entities have created specialized police bodies to counter terrorism and extremism. But, as is well known and has been demonstrated previously, most visibly during the February 2014 protests, cooperation and coordination among these various structures is ad hoc and sporadic at best – not based on any institutionalized mechanisms, but rather often dependent on personalities and individual initiative.

On February 2nd, 2014, two referenda took place in the Administrative-Territorial Unit Gagauz-Yeri (UTAG Gagauzia) - one of consultative and the other one of “legislative” character. In the first case, the residents of Gagauzia were called to cast their votes over the foreign policy vector of the Republic of Moldova and namely, to say if they are in favour of the country joining the European Union or the Russia- Belorussia- Kazakhstan Customs Union. In the second case, the citizens of the region had to say if they agree that the Gagauz autonomy exercises its right to the external self-determination in case the Republic of Moldova loses its independence.

Contrary to the Mead controversy where suspicion in fieldwork has been attributed to lack of competence or failure, the present paper considers suspicion as important ethnographic data. Through re-telling the difficulties of a research carried out among the Roma residents of a Romanian shantytown, I try to reveal all the mechanisms that are responsible for both creating suspicion and detaching the researcher from her/his informants. Embedded in Eastern-European social and political changes, mistrust in this field goes back to an initial territorial stigma attached to the locals. My research site, "the Green block of flats" has become a ghetto due to massive unemployment and differences in living conditions, where isolation from the outer world has been enforced by misunderstandings with local institutions. Being "used" by NGOs and subjected to unfulfilled treatment under the label of "helping the Roma", shantytown residents could but reject the newcomer researcher who seemed to be one of "them".

The aim of this note is to provide recommendations on improvement of the draft law as well as of the certain elements of mechanisms present in Moldova on preventing and combating money laundering, so that to protect the fundamental rights, proper functioning of the business environment and to preserve a rational approach to prevention and combating the money laundering phenomenon. It is vitally important to understand the general context and the role of prevention and combating money laundering in such context. The primary goal of modern societies and states is to eradicate organized crime, drug trafficking, human trafficking, organ trafficking and illegal arms trafficking. In this context the international community developed services to identify and fight these crimes. Once the technologies were developed and the financial flows enhanced, it became obvious that the criminals’ ultimate goal is to bring the enormous income back into the legal ‘white’ circulation. And after realizing this fact, the combating of money laundering was organized and the money laundering activity was incriminated to attack the results of illegal activity.

Over the past decade, Serbia’s foreign policy has been defined by the key dilemmas it faces over the shape of the state, including the issue of Kosovo, and the desire to balance between the main actors present in the Balkans: the West, Russia and China. The Serbian ruling class have been trying to play these actors off each other and balance their influences for their own benefit and also, in part, for the benefit of the state. The Russian invasion of Ukraine has significantly reduced their room for manoeuvre. They have come under pressure from the West, which wants Belgrade to pursue a foreign policy in line with the Western course and to limit its ties with Moscow. Despite symbolic gestures of support for the Kremlin, the Serbian government seems to be increasingly aware that Russia is decreasingly capable of protecting Belgrade’s interests. Although in some areas Moscow may be replaced by Beijing, Serbia is set to step up efforts to build closer ties with Western structures.
