Summary/Abstract: Given the incompatibility of the 2 approaches (state control versus market surveillance), if the draft amendment of Law no. 131/2012 is approved by the parliament, we risk to be assessed as non-compliant with market surveillance legislation, and the signing of the ECA and even the whole process of European integration risks to be stalled. As an entity that monitors and reports on the progress of harmonization of national legislation with the EU, the State Chancellery should have been the first institution to stop any legislative amendment that faithfully transposes EU directives and regulations, and that has been assessed by the European Commission as being in conformity with the acquis Communautaire.
