Summary/Abstract: The problem of the decision creating a binding obligation resting onthe inspected entrepreneur to pay laboratory fees (based on Article 30of the Trade Inspection Act) has not been a subject of a broader discussionin the literature. However, considering practice of its application, itneeds to be examined closer. In particular, a legal form of this obligationshould be analysed in the context of regulations related to fees laid downin Polish Code of Administrative Procedure and other regulations relatedto product safety and market surveillance (also controlled by TradeInspection in Poland). The important question is also the ratio of thisobligation to administrative sanctions regulated in Article 40a, section1, points 3, 4 and section 3 of Polish Act concerning trade quality ofagri-food products – for commercial introduction of products that do nothave this quality (including adulterated products).
