Summary/Abstract: This report examines the recovery procedure under the Commercial Code in the context of the harmonized rules for preservation and recovery of the undertakings that has been introduced by Directive (EU) 2019/1023. The aim is to answer the question of whether the existing system can be assessed as one of the tools to prevent insolvency and to give a second chance for the entrepreneurs in difficulty.
