Summary/Abstract: The Special Pledges Act does not provide effective means of protection from creditors acting in bad faith upon pledge enforcement. The pledge enforcement represents a unilateral action by a creditor with no legal tools for checking the legality of his action. The only foreseen possibility of protection is the declaratory action under Art. 36 of the Special Pledges Act which however does not suspend the pledge enforcement.
