Summary/Abstract: An insurance intermediary, like any other entrepreneur, operates in a formal and legal environment shaped by factors on which it has limited influence. This element of the external environment determines management decisions concerning the commencement and subsequent continuation of insurance distribution activities on the insurance services market. The article emphasises the role of a complex legal system in the financial markets, which is part of the macro-environment of the insurance services company, shaped by the EU and national legislation. This system is currently based on the leading paradigm of protecting the financial market consumer in the broadest sense. The author points out that the creation of a huge number of legal acts and regulations of a soft-law nature which are subject to frequent changes and of varying quality also encourages negative phenomena which constitute a significant obstacle to the stable functioning and development of agency and brokerage firms.
