Summary/Abstract: The prohibition of trafficking in human beings has been incorporated in numerous international documents, as well as provisions of the Constitution of the Republic of Serbia. The obligation by the state to secure protection of human trafficking victims, especially the protection and realisation of their rights in court proceedings, clearly arises from international, as well as national legislation and policy framework. Even though they have been clearly defined in the ratified international documents binding for the Republic of Serbia, as well as in the practice of the European Court of Human Rights, the rights of human trafficking victims often remain unfulfilled in the judicial practice of regular courts. In spite of harmonisation of the legislative and policy framework with the defined standards of the protection of victims in this field, analyses of the court practice and case law indicate that, when it comes to its key aspects, of fulfilment victims’ rights does not always attain the guaranteed level.
