Summary/Abstract: The analyzes of the Research Forum of the European Movement in Serbia were conducted with the intention of covering all obligations up to the moment of membership and going beyond the current political moment of amending the Constitution initiated in accordance with the dynamics foreseen in the Action Plan for chapter 23 - Judiciary and fundamental rights. We find the reason for conducting the analysis in the fact that member states must ensure the full and correct application of the legal acquis of the European Union on their territory from the moment of accession. Also, the Treaty on the Accession of the Republic of Serbia to the European Union must be in accordance with the Constitution of the Republic of Serbia so that it can be confirmed by the National Assembly of the Republic of Serbia.
