Summary/Abstract: In the process of transforming and reforming the state, the stability of institutions that guarantee democracy, the rule of law, human rights, respect and protection of minorities, seems to be the most challenging and demanding task for the authorities, as well as for society. These, on the other hand, are also part of the criteria that our country must fulfill on the way to EU membership. As mentioned in the 2010 Progress Report, the framework electoral legislation has been partially revised, but "constitutional and legal provisions that are not in accordance with European standards are still in force". They refer to the control that political parties have over the mandates of deputies and the ability of parties to arbitrarily appoint their deputies, instead of following the order of candidates as on the electoral list. In practice, the issue of party control over the mandates of deputies has a negative effect on the representative role of the Parliament.
