Summary/Abstract: In the context of the processing of personal data that is actually carried out by the operators, both in the public and private sector, a parallel is drawn between how the legislation establishing the processing of personal data should looks like, in order to comply with a legal obligation of the controller, or in order to performance of a task caried out in the public interest and how they most often look like in reality. When personal data processing operations are established by a new law, it must be assessed whether this implies the restriction of certain rights or freedoms of natural persons.
