Summary/Abstract: The article captures a procedural issue regarding the establishment of panels vested in criminal trials, the solution of which involves assessing the lawfulness of public procurement procedures. The author observes the obligation imposed by the special law for this assessment – qualified as a preliminary issue within the criminal trial – to be carried out by a panel specialized in public procurement, considering that it is mandatory that such court panels to be established within criminal courts.
