CONSIDERATIONS REGARDING THE NOTION “FAMILY MEMBER”. EVOLUTION OF LEGAL REGULATION

Summary/Abstract: The family was a priority of the Romanian legislator, who gave increased importance to the family institution. For example, the "Explanatory Memorandum" of the Criminal Code of 1968 states that "in our organization, the development and consolidation of the family is a major concern of the state, of society as a whole." The family, in modern society, has been protected not only by the Romanian legislator, but also by European and international bodies, there are constant concerns in adopting an optimal legal framework. The adoption of the European Convention on Human Rights in 1950 was an important moment in ensuring the legislative framework necessary to protect private and family life.
