Summary/Abstract: Within this scientific article the author will briefly approach some views of the specialized literature which consider; in the light of the new criminal classification; that embezzlement has become; as a result of the intervention of the law; mainly an offence entailing dangerousness; and thus damage would be irrelevant for its actual perpetration. In this frame of mind; we shall also examine the impact of the scientific hypothesis on judicial practice; since it should develop at the same time as doctrinal opinions change.
