Summary/Abstract: This paper aims to present the controversies in the judicial practice related to the meaning of intervention service as an element of the criminal offence of the violation of guard and security duty provided for by art. 415 of the Criminal Code, committed by the military within the Romanian General Inspectorate for Emergency Situations through alcohol consumption in the exercise of the specific tasks of the intervention service and possible elements of unconstitutionality in this matter.
