About the trial suspension. A brief analysis of some (possible) inconsistencies of Articles 413 and 414 of the Code of Civil Procedure

Summary/Abstract: The stay of proceedings can sometimes raise real procedural problems, arising from a number of rules in the Code of Civil Procedure which are sometimes unclearly drafted. In this study, we have analyzed the procedure and effects of the suspension of the trial, as well as the procedure for the resumption of the trial, also highlighting those aspects that in practice can leave room for interpretations that can sometimes lead to disregard of the procedural rights of the parties. Also, from the interpretation that we have given to the institutions analyzed, de lege ferenda, we hope that, in the not too distant future, the legislator will find the time to analyze them in a competent manner and to clarify those aspects that currently generate confusion.
