Summary/Abstract: One of the titles of nullity of marriage is the simulation of conjugal consent (simulatio consensus matrimonialis), sanctioned in can. 1101 § 2 of the CCP in force. In such a case, there is a clear discrepancy between the words (or equivalent signs) and the marriage consent understood as an act of will (can. 1057 § 2 of the Code of Canon Law), i.e. an internal act. The spoken words or the appropriate signs are then not covered by the will of the counterparty, while it is the will that determines the formation of the marriage bond, in accordance with can. 1057 § 1 of the Code of Criminal Procedure.In the structure of the simulation of marital consent, both total (exclusion of the marriage itself) and partial (exclusion of some essential element of marriage or an essential attribute), an essential component is a positive act of the will, by virtue of which the spouse disqualifies this. Referring to the simulation of marriage consent, John Paul II, in his speech to the Roman Rota of January 29, 1993, said that “it would be a serious wound inflicted on the durability of marriage, and therefore its sanctity, if the simulation fact were not always specified by the alleged simulator in a positive act of will.”After presenting a historical outline of the shaping of the legal norm (can. 1101 § 2 of the Code of Criminal Procedure), the author, taking into account the achievements of both the doctrine and the jurisprudence of the Roman Rota, defines the concept of a positive act of will, then indicates the ways and forms of taking it, and finally discusses its proving.
