Summary/Abstract: In this paper, the author shows that in the canonical legal order, the position of Jehovah’s Witness in relation to mixed marriages has changed as a result of the decision of the Congregation for Science and Faith, April 4, 1966, to invalidate their baptism. As a result, their status has changed because they are treated as unbaptized. The author has shown that this status affects the fulfilment of legal requirements for mixed marriages. In this case, a marriage with a Catholic is fortified by a breaking obstacle of religious diversity (can. 1086 KPK). Therefore it is necessary to obtain a dispensation for the marriage (can. 1086 § 2 of the KPK). For this reason, according to the author, due to the significant religious differences of nupturients, a more rigorous approach should be taken to the question of meeting the requirements set out in can. 1125, n. 2–3 KPK.
