Summary/Abstract: Lockout in many countries worldwide is a universal tool of settling collective bargains. Such collective action undertaken by employers has been constitutionally anchored in the Republic of Turkey for the last sixty years and is now regulated in detail on a statutory level. Despite profound and rapid social, demographic, economic and cultural changes over the Bosporus in this period the power of employers to apply retortion in the shape of lockout has never been questioned. The goal of the article is an analysis of constitutional and statutory regulation of lockout and evaluation of how a high level of trade unions’ membership and strong position of employers’ associations have turned lockout into an effective and lively instrument shaping individual employment relations. Taking into account an increasing international position of the Republic of Turkey (founding member of OECD and a member of G20 Group) as well as the Polish discussion over lockout, recurring in recent years around the draft Collective Labour Code of 2007 and draft Code of Collective Labour Law of 2017, Turkish experiences involving lockout seem a precious comparative source enriching the debate over collective disputes in Poland.
