Summary/Abstract: Act of May 1989 concerning the quarantee of freedom of conscience and religion and relations between the state and Catholic church in Poland due their importance was equipped with a solemn introduction raising the rank of these provisions even more. However, the formula adopted earlier, today requires changes that respect human dignity and his subjetivity. Hence, not only directives from European Union law and fact of Poland’s membership in the Council of Europe should be taken into account.
