Summary/Abstract: This article is devoted to the issue of detention of refuges and asylum seekers as part of asylum and migration procedures, analyzed from the point of view of the interaction between human rights law and refugee law. The purpose of these considerations is to answer the question whether and how the European Court of Human Rights applies the refugee law provisions in the light of the right to liberty and personal security covered in art. 5 of the ECHR. This issue is complex because it concerns two legal regimes which differ in regard to the grounds and permissibility of administrative detention of refugees and asylum seekers. The European Court’s case law analysis led to the conclusion that although the Court takes into account the refugee law standards, its attitude seems to be strongly influenced by the fact that immigration detention is closely connected with the states’ right to control foreigners’ movements within the State’s territory. As a consequence, not all solutions the refugee law contained are taken into account. In particularly, this concerns of the principle that the detention shall be used as an ultimate measure.
