Institutional and legal challenges of Montenegro on the road to membership in the European Union

Summary/Abstract: Institutional and legal challenges of external nature in the context of Montenegro’s accession to the European Union concern the European Union’s relationship with Montenegro as a country of the Western Balkan — a region for which the European Union has a specially defined agenda for the EU membership. Within this segment of the European Union’s relations with the region of the Western Balkans, and Montenegro in particular, a significant role belongs to the so-called Berlin process of enlargement of the European Union to the countries of the Western Balkans, as well as the relevant strategic documents of the European Commission and the political declarations from the summit of the leaders of the European Union and the leaders of the countries of the Western Balkans. For each country in the Western Balkans, the European Commission annually prepares progress reports (towards membership in the European Union), within which special emphasis is placed on the analyzed situations related to the administrative capacity of the candidate country to successfully apply the standards and values of the European Union. According to the European Commission’s Report on Montenegro for 2019, Montenegro has achieved a good level of preparedness in some areas (e. g. foreign security and defense) and in other areas measures moderate progress (e. g. competition policy, agriculture and rural development). Strengthening administrative capacity to ensure the implementation of the acquis remains a significant challenge for Montenegro.
