Summary/Abstract: The Prosecutor General of the Prosecutor's Office attached to the High Court of Cassation and Justice, in case of refuting a solution ordered by a prosecutor from the subordinate prosecutor's offices or specialized structures of the Prosecutor's Office attached to the High Court of Cassation and Justice (National Anticorruption Directorate, Directorate for Investigating Organized Crime and Terrorism), does not have in all the situations the quality expressly provided for by Article 335 (1) of the Code of Criminal Procedure which refers to “the hierarchically superior prosecutor to the one who ordered the solution”.
