Summary/Abstract: The rules of criminal procedure unequivocally enshrine the obligation of the referring court to initiate the mechanism of unification of judicial practice prior to the final settlement of the case brought before it, such a condition being the essence of the preliminary ruling procedure and differentiating this legal instrument from the appeal in the interest of the law. Since the complaint did not meet the conditions of admissibility of referral to the Supreme Court to issue a preliminary ruling, namely the necessary and cumulative condition to refer to the High Court of Cassation and Justice until the closing of its proceedings, the complaint was rejected as inadmissible.
