Summary/Abstract: This article aims to define an exact moment when the rector of the university is suspended from his or her duties according to Article 432 section 4 of the Law on Higher Education and Science. The authors analyze the legal meaning of the premise: “Criminal proceedings in cases prosecuted by public accusation”. Using the linguistic, systematic, and functional interpretation authors present many arguments that implicate this provision cannot apply at the time the charges are presented, but only when the indictment is filed by the public prosecutor. The authors indicate that the public prosecutor may use other provisions of the Polish Code of Criminal Procedure, especially Article 276 (a preventive measure of suspension in the execution of duties) if it is considered appropriate and necessary to prevent the rector from performing his or her duties. The difference is relevant, as a preventive measure applies at the prosecutor’s discretion, whereas Article 432 section 4 of the Law on Higher Education and Science applies ex lege.
