Summary/Abstract: The author discusses the issues related to the possibility evidentiary use of a psychiatric opinion drew up with overrun maximum date determined in Article 203 § 3 of the Criminal Procedure Code. The commentator agrees with the view of the Supreme Court in its decision of 19 November 2014 (V KK 259/14), according to which the fact of exceeding the maximum observation period in a medical institution (Article 203 § 3 of the Criminal Procedure Code) does not justify the impossibility to use an opinion prepared after such observation in the process. Furthermore, the commentator draws attention to the possible procedural consequences of recognizing that psychiatric opinion drawn up with overrun maximum date determined in Article 203 § 3 of the Criminal Procedure Code cannot serve as evidence in the case.
