On Selected Aspects of the New Canon Law on Marital Procedural Rules

Summary/Abstract: The article discusses changes to the Western procedural canon law of marriage with regard to the declaration of nullity of marriage, as introduced during the Synod of Bishops by Motu Proprio of Pope Francis Mitis Iudex Dominus Iesus on 15 August 2015. It is too early to evaluate the new law because of a lack of cases interpreting the law. The author analyzes possible challenges that the application of the new law will generate, in particular with regard to what is labeled an abbreviated procedure before a diocesan bishop. The new law entered into effect on 8 December 2015 and completely replaced canons 1671–1691 of the Code of Canon Law.
