Problematic issues of procedural actions aimed at obtaining information from material sources in the investigation of criminal offenses committed by fraud

Summary/Abstract: One of the main means of forming the evidence base is investigative (search) actions. It is emphasized that during their conduct, both criminal procedural and constitutional requirements should be observed, as well as to promote the realization of the rights of all participants in criminal proceedings. It speaks about cases of restriction of human rights and freedoms determined by law. We are talking about a search, temporary access to things and documents, an investigative examination. It is these procedural actions that are aimed at seizing material sources that may form the basis of suspicion, as well as accusations in court. Meanwhile, it is emphasized that evidence must be obtained legally and meet the requirements of admissibility, relevance and sufficiency. Problem situations that may arise during a search, temporary access to things and documents, inspection are considered, ways of resolving such problem situations are proposed.
