Non-unitary judicial practice. The transitional law in the case of the legal provisions on the exception of unlawfulness of individual administrative acts

Summary/Abstract: A law issue which has experienced different gaps in its scope and which has generated lengthy debates has been the exception to the unlawfulness of the administrative act. Although the admissibility or inadmissibility of the exception of unlawfulness for the individual administrative acts issued prior to the entry into force of Law no. 554/2004 has been debated in many specialized papers, this study aims to present the recent views of the courts, the decisions of the High Court of Cassation and Justice, the decisions of the Constitutional Court, as well as doctrinal opinions on this issue.
