Summary/Abstract: This article refers to the evolution and the current state of the mechanisms related to the respect of the rule of law by the EU Member States, starting from the adoption of the Article 7 of the Treaty on European Union and the repeated attempts to apply it. The following issues are discussed - the Commission Communication from 2014 that formulated for the first time an official definition of the rule of law, the Veld Report of the European Parliament from 2016 on democracy, rule of law and fundamental rights that offers also a definition of rule of law, the attempts to aplply the current mechanisms regarding rule of law in the case of Poland, involving both the Commission and the European Court of Justice, the Communication of the Commission from 2019 on strengthening the rule of law in the framework of the EU that refers to the evaluation of all 27 Member States from the rule of law perspective and the Report on the rule of law in the case of Romania adopted in 2020.
