Summary/Abstract: This is a report on an attempt made to establish the impact of the patricio-plebeian conflict of Orders on the Decemviral Code. In Part One the main trends of social development during the archaic period of Rome (sixth to mid-fifth century BC), resulting in the creation of the written law, are outlined and briefly discussed. Along with the conflict of Orders, the endeavours to restrain the political influence of patriarchal structures (gentes) with ensuing consolidation of the Roman civic community, have an essential practical bearing on this transition. The legal provisions which may be directly linked to this conflict play minor role in terms of the remaining legal rules of the Code, e. g. civil procedure, restriction of funeral luxury and the like.
