On the problem of parliamentary immunity

Summary/Abstract: The paper deals with the problem of parliamentary immunity. The immunity of the members of Parliament is analyzed from the point of view of substantive and procedural Criminal Law. The immunity is reviewed critically on constitutional grounds. On the basis of the analysis, the conclusion is reached, that the existing regulations regarding immunity are inconsistent with the constitutional principle of equality before the law and the prohibition of privileges. Finally, and based on the summary of the principles regarding immunity, an attempt is made to offer some guidelines for the improvement of the regulations on the parliamentary immunity.
