Summary/Abstract: The evolutionary context of the Romanian democratic society after the fall of the communist regime goes through several stages, including the interest of the present study, the way in which the citizens of this state understood to proclaim their just demands through large public demonstrations, in antithesis to the anachronistic model. its authorities understand to regulate the forms of public manifestation. Thus, the legislative framework established for the organization and conduct of public assemblies, which, although applicable to cultural, religious or sporting events, becomes controversial when it comes to its implementation in the face of protests taking place in public, We try to highlight through this paper the transformation in time of the regulation of the right to protest in Romania, raising our attention, the legislative proposal for amending and supplementing the norms on the organization and conduct of public meetings, registered at the Chamber of Deputies of the Romanian Parliament. dated 01.02.2021. Last but not least, compared to the major changes expected in the legislative area of ​​public demonstrations and protest activities, we will analyze, along with European principles governing the protection of human rights, elements of comparative law, subjecting a cross-examination, the framework legislatively operable to the legitimate forms of manifestation of the citizens, among the consolidated European democracies, such as the French state and the one applicable in the national space, which knows in recent history, an appreciable evolution of the volume and diversity of public protests.
