Procedural Aspects of Forced Realisation of Lien in the Slovak Republic

Summary/Abstract: The author deals with the aplication problems of the realisation of lien in the field of procedural law, e.g. execution proceedings. He points basic problems in present legal regulation of the theme and gives suggestions de lege ferenda for legislation. He also focuses on the doctrine of The Constitutional Court of The Slovak republic, related to the theme, which defends illegitimate reduction of the right to judicial protection of the creditor, who is actor during executional proceedings.
