The Special Aims of the Trafficking in Persons Crime

Summary/Abstract: The article analyses the content of the aims for sexual exploitation, forced labour exploitation, removal of corporal organs and submission to servitude which characterise the mens rea of the trafficking in persons crime under Article 159а, para 1 of the Criminal Code, as well as the aim to sell an unborn child under Article 159а, para 3 of the Criminal Code.The text clarifies the content and scope of application of each aim and their interrelations. It also elaborates on certain special cases of complication of the mens rea and corpus delicti of human trafficking conducted under the conditions of multiple aims, multiple perpetrators and specific features of the victim. A detailed research of the relevant international legal standards and of the legislative experience of their Member-States is provided. The resolutions of Bulgarian legislation are assessed on the basis of an analysis of their relation to the international conventions and of the conclusions drawn from their comparison to foreign legislative practices. In line with this suggestions de lege ferenda have been made.
