Summary/Abstract: We are witnessing times when social inequality is the result of differences pertaining to social status, lifestyle and consumption. Globalization, besides many other effects, has a major influence on the increase of consumption in all social classes. The increase in consumption has led to facilitating the access of the population to different banking products / credits which have led to the emergence of payment incapacities for several individuals and legal entities. The constant change of the credit terms and conditions determined the imbalance between the outstanding liability and the accessed credits, resulting in an inability to pay for a good part of the population. Are Insolvency Laws a Solution for Debt Support? What is the fate of the assets of legal entities and natural persons in the case of payment incapacities due to over-indebtedness? Does over-indebtedness have a major impact in determining social and economic policies at a national level or do these policies influence the degree of over-indebtedness? To what extent are the conditions for granting loans fully understood by the debtors accessing these loans. Why the law of incapacity for payment for individuals did not have the expected impact. Can current legislation support people and help them in their recovery efforts?
