Jurisdiction of the enforcement court and of the bailiff in the enforcement procedure – certain issues

Summary/Abstract: Apparently, the issues related to the jurisdiction of the bailiff and, especially, of the enforcement court, should not have led to any discussions in relation to the applicable regulation, however, a detailed examination may identify various practical situations which require special attention. The literature has only partially dealt with these assumptions, which is why we intend to expose, in this article, certain issues which could be identified in relation to the cases of lack of jurisdiction of the enforcement court or of the bailiff.
