Summary/Abstract: Article 62 of the Law on Consumer Protection prohibits unsolicited supply of goods or services to consumers (so-called inertia selling). Moreover, the consumer has no duty to return unsolicited goods and can keep them free of charge. Considering the fact that in this case there is no valid contract between the consumer and the professional, it looks like there is no justification for the consumer’s enrichment. The article provides an analysis of Art. 62 of the Law on Consumer Protection and offers an explanation of the rule, from the perspective of three theories which are part of the unjustified enrichment doctrine.
