On the Role of Pension Legal Relations in the State Social Security System

Summary/Abstract: The topic of research is the role of the pension legal relation in the classification of social insurance legal relations. The pension legal relation is considered as a social insurance relation within the long-term state social insurance and as a social insurance relation with regard to the spending of social insurance funds. The article discusses the issue whether the pension legal relation may be considered a version of the social insurance relation between the social insurance authority and the socially insured person. A conclusion is made that pension relations constitute a separate type of social insurance relations, which stems from certain facts and circumstances and does not result from a specific development or transformation of the social insurance relation between the social insurance authority and the socially insured person. In this context, the article examines the establishment of the pension legal relation in case of retirement pensions, disability pensions and survivor pensions in the state state social insurance.
