Summary/Abstract: The product liabilty act number 59/1998 established the new law institute in the czech legislation order - product liability. The product liability act issues from the Council directive of 25. July 1985 on the approximation of the laws, regulations and administrative provisions of the member states concerning liability for defective products (85/374/EEC).The product liability is the objective liability for damage caused by a defect product. It is not the absolute (unrestricted) liability, because there are the reasons (enumerative), on which base the producer shall not be liable. It is interesting, that the duty of compensation of damage exists between the injured person and the producer. There is not (mostly) a direct contract. The aim of this publication is to classify the product liability act with the context of the law of the European communities and to do the comparison between the product liability act and the Council directive 85/374/EEC. The next purpose of this publication is to show, that the legislation relations, which are based on the product liability, can contain the international factor and there is a solution in the czech legislation order for these relations.
