A few considerations regarding the criminal protection of intellectual property

Summary/Abstract: Criminal protection of intellectual property is, as has often been noted, a rather sensitive topic. Maintaining the identity of the intellectual property law, as well as other branches of law that have special regulations regarding certain offenses, led to keeping these provisions in Law 8/1996, even after the Penal Code was amended. The need for criminal protection in the field of copyright has been imposed not necessarily from a need to protect the public interest, but from the interest of protecting certain forms of activity or private property. Specifically, there have been numerous notifications by authors, film companies, record companies regarding the violation of these rights. Copyright protection actually ensures the existence and development of the creation, without which progress would not be possible. In national law, copyright infringements are regulated by gravity, manner of committing, but especially by the consequences of actions. The intention, direct or indirect, is specific to these facts, and from the aspect of the material element, they are likely to be committed through the Internet many times.
