The Contract of Social Service Management Assignment

Summary/Abstract: The study deals with the specifics of a con- tract concluded after a competition procedure of social service management assignment under Art. 18a, para. 3 of the Law on Social Assistance (LSA). The need for reconsidering its legal nature arises from the newly introduced regulation on 'administrative contracts' under Art. 19a of the Administrative Procedure Code (APC). Arguments are given in favour of the view that the contract of social service management assignment constitutes a variety of the category of administrative contracts. The article analyzes the various aspects of the content of the contract, its subject matter and its object, its conclusion and performance, as well as matters related to jurisdiction. The contract of social service management assignment is differentiated from the public procurement contract and the concession contract.
