Summary/Abstract: In modern society, the problem of recidivism raises numerous problems and question marks. What is it? How does it appear? Why? How can we repress this problem? To clarify these dilemmas, psycho-sociology and law experts launch various theories and practical ways of phenomenological, legal or social framing. Through this study, we aimed to make a brief foray into the conceptual issue of recidivism, as well as a comparative study of the regulation of recidivism in Romania, according to the old and new Criminal Code. This study is useful primarily for law students, masters, but also specialists working in the field of law.
