Summary/Abstract: Drawing on the criminal charge against a prominent Slovak commentator Michal Havran, the paper focuses on the issue of freedom of the press as well as freedom of speech against the background of possible criminal law. Methodologically, it applies conceptual and comparative analysis and subsequent synthesis of findings. It is divided into four parts. In the first, the authors briefly recapitulate the basic story lineand the factual line of the case; in the second, they clarify the basic concepts involved in the case—commentary as a journalistic genre and hate speech; in the third, they place these concepts in the context of the case together with the juxtaposition of the decision of The Print-Digital Council of the Slovak Republic in the given case; in the final fourth part, they draw conclusions. The aim of this study is to establish a trend of active interdisciplinary involvement of the scientific and academic community in the defence and strengthening of the rule of law and civil society on the basis of improving socially responsible professional journalism.
