The rights and the duties of the Communities public servant

Summary/Abstract: The author presents and examines the rights and the duties of the Community public servant according to the provisions of the European public servants standing orders and the western doctrine. The following rights are analyzed: the right to opinion and freedom of expression, circumstanced by certain duties such as neutrality, loyalty, reservation and measure; the right to associate in unions and the unions existing at present; the right to vacation; the right to candidate for elective positions; the right to a career; the right to pension; the right to professional training; the right to remuneration for oneʼs work; the right to uniform, to payment of extra working hours, to normal working conditions, to social protection, to aid and assistance from the communities, to receive any formal communication in writing, the right to descendantʼs pension. The second part of the study is devoted to obligations, such as: independence and neutrality, reservation and discretion; the obligation to fulfil oneʼs tasks with maximum professional conscience; residence, respect for the hierarchic order, faithfulness; the obligation to be medically examined every year; such duties as morality and reparation of prejudices.
