Summary/Abstract: The Community law protects both formal and effective equality, which does not mean that the Community Treaties and the secondary legislation or the jurisprudence of the European Court of Justice, by declaring it a fundamental principle of law, would favour a certain theory of equality. It could rather be said that the Community sources of law follow the non-linear nature of European integration, sometimes taking into account the context of the facts and the interests coming from the economic field, while other times they try to go beyond the way the legal systems of the Member States accept this principle, and induce a supranational consensus. The category of rights that consecrate the equality of the European citizens is regulated distinctively in Title II of The Charter of Fundamental Rights of the European Union, including seven directions to approach the concept of equality: equality in rights; non-discrimination (the principle of non-discrimination on grounds of citizenship or nationality); non-discrimination between producers and consumers in the field of agriculture; non-discrimination between men and women on the labour market; the principle of non-discrimination on grounds of sexual orientation; cultural, religious and linguistic diversity; equality between men and women; the rights of the child; the rights of elderly persons; integration of disabled persons.
