Summary/Abstract: The Treaty of Lisbon modifies the applicable treaties without substituting them. The author refers to the modifications operated on the Treaty on the European Union and the Treaty Instituting the European Community focusing on human rights aspects. Thus, Para 3 of Art. 1 confers legal force to the fundamental values of the European Union. Particularly important are the modifications operated on Art. 6, according to which The Union acknowledges the rights, the freedoms and the principles provided by The Charter of Fundamental Rights of the European Union, which is assigned the same legal value as the Treaties. As far as the provisions on the jurisdiction of the European Union is concerned, she refers to and examines the provisions devoted to the Court of Justice of the European Union, a re-organized institution, which shall include The Court of Justice, The Tribunal, and the special tribunals, whose role shall be to ensure the observance of the law with the interpretation and the application of The Treaties. In the end, the author refers to the principle of the protection of the fundamental human rights in the Community jurisprudence.
